IMPORTANCE
OF A WARRANTY
Different vinyl
fence manufacturers provide a wide range of warranties. Some last
10 to 20 years. Some companies offer lifetime warranties. The question
a consumer needs to ask is, "What is the difference in products
and warranties?"
To make a durable
vinyl fence product, manufacturers must blend the right ingredients
in the resin and extrude it at the proper temperature. If this process
is not followed correctly, the vinyl fence will have poor durability
with different weather conditions. The fence may turn yellow, lack
strength, and crack in harsh weather conditions.
Our vinyl profile
manufacturers use ingredients and processing controls that ensure
compliance to ASTM standards. Material warranties should refer to
an ASTM F964-94 vinyl fence standard.
Titanium Dioxide
(Ti02) is the ultraviolet inhibitor and is used in paint, plastics
and other outdoor products to protect them from the sun. Ti02 is
the most expensive ingredient in the manufacturing of vinyl fence.
Ten percent (10%) or more is necessary to have a product with a
lifetime warranty.
Another critical
additive in the polyvinyl chloride formula is called impact modifiers
(acrylics). The superior vinyl manufacturers use over five (5) parts
100.
If vinyl fence
is formulated and manufactured correctly, it will be good for a
lifetime. If the manufacturers warranty is less than lifetime or
requires a lot of hoop jumping to preserve the consumers' rights,
ask "why?".

Vinylbiz Inc.
(VBI) warrants its vinyl fence products are free from defects in
material and manufacturing workmanship. When installed according
to VBI instructions and under normal and proper use, VBI vinyl fencing
will uniformly maintain its color and will not peel, pit, rot, blister,
warp, crack, corrode or be consumed by insects. If such a defect
or degradation is discovered, VBI, at its option, will repair or
replace the defective material. VBI will cover all corresponding
labor costs.
This warranty
covers defects in material and/or manufacturing workmanship. It
does not cover failure of or damage to the fence resulting from
faulty or improper installation; improper use; settlement or any
failure of any structure or soil on or in which the fence is installed;
exposure to acid rain or other harmful chemicals; or normal and
expected weathering (normal color hold standards are the same as
used for windows or siding as defined in ASTM D3679).
To exercise
your rights under this warranty, you must notify VBI in writing
at the following address: Vinylbiz, Inc., P.O. Box 3807 Dana Point,
CA 92629. In your notice, briefly state the nature of your claim
and include proof of installation date and proof of purchase. VBI
will direct and organize all covered remedies. VBI shall not be
responsible for the cost of any repairs or replacement undertaken
by owner.
VBI may direct
a company, dealer, contractor, applicator or distributor to perform
any of its obligations under this warranty. If a claim is made under
this warranty on a product that is no longer available, VBI reserves
the right to provide a similar product of equal quality and value.
VBI makes no express warranties except those as stated above. ALL
IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES
OF MERC14ANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.
Some states do not allow limitations on implied warranties, so the
above limitation may not apply to you.
IN NO CASE SHALL
VBI BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some
states do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation may not apply to
you. The extent VBI's liability and owner's exclusive remedy under
this warranty is limited to repair or replacement to be determined
at VBI's discretion.
This is a "limited
warranty" within the meaning of the Magnuson-Moss Warranty - Federal
Trade Commission Improvement Act. This warranty gives you specific
legal rights and you may also have other rights that may vary from
state to state.
In the event
a Homeowner, Homeowner's Association, or other entity prefers to
litigate a dispute with the warranty or other dispute, both parties
agree that the proper venue will be in Orange County, California
or the state of Nevada.
